Your Account and Placing an Order

You are not legally obligated to provide us personal information, and you hereby confirm that providing us personal information is at your own free will. You confirm that all information and details provided by you (including upon registration) are true, accurate and up to date in all respects and at all times.

When you create an account we may provide you with and/or ask you to use passwords or other means to allow you to access certain areas of the website and/or to maintain your account security. If you access or use any Site, you are responsible for maintaining the confidentiality of your account and for restricting access to your computer. You agree to be responsible for all activities that occur under Your Account or password. If you are under 18 years old, you may use SGDX.com only with the involvement of a parent or guardian. SGDX reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders in its sole discretion. If SGDX is suspicious of any fraudulent activity coming from your account, it can reserve the right to refuse you access to your Account and can delete the account.

Acceptance of your Order

Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. We will notify you by email as soon as possible to acknowledge that we have received and are processing your order (“Confirmation Notice”). Loose diamonds are shipped 1-7 days after payment, though certain diamonds may be shipped up to 14 days after payment, and all other jewelry and engagement rings will be shipped in 1-4 weeks, depending on the production schedule of that item. Prior to dispatch of the product(s), SGDX has the right to decline an order at its discretion and for any reason (for example, this may happen for legal or regulatory reasons or for reasons related to availability or stock). To the maximum extent permitted by law, SGDX shall have no liability to you as a result of such refusal of any such order submitted.

If we cannot supply you with the product or service you ordered, we will not process your order and inform you of this in writing (via email) and, if you have already paid for the product, we will refund you in full as soon as reasonably possible, but in any event no later than 21 days after receipt of your payment.

Delivery

SGDX may choose the carriers at its discretion. Delivery charges and timescales vary depending on the type of products ordered, the service you select and the delivery address.

Please note that certain products and services may be subject to alternative delivery charges, restrictions and/or timescales. If delivery cannot be made to a customer due to the customer not being present at the address at the time allotted by the carrier or if a customer refuses to accept the products, SGDX reserves the right to deduct the cost for returning products to the SGDX returns center from the customer’s refund for the order.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

Where the supply of your product(s) or service(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but, to the maximum extent permitted by law, shall be under no liability to you for such delay or failure. For the avoidance of doubt, this paragraph does not exclude or effect in any way any statutory right that is afforded to you to cancel an order when a product is delayed or not provided.

Your Right to Cancel and Refunds

Damaged or Incorrectly Supplied Products

You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (by calling Customer Service at +65.88788788 or sending an email to support@sgdx.com) within a reasonable period of time. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied.

User Submissions

The Site may permit the submission, sharing and publishing of the content (names, story and photos) sent by you (“User Submissions”). You understand that whether or not such User Submissions are published, we do not guarantee any confidentiality with respect to any User Submissions. You shall be solely responsible for your User Submissions and the consequences of posting, publishing or uploading them. We have complete discretion whether to publish your User Submissions and we reserve the right in our sole discretion and without further notice to you, to remove and/or delete any and all content posted on the Site (including User Submissions) at any time and for any reason.

Ownership of User Submissions

You represent and warrant that you own or have the necessary rights and permissions to use and authorize SGDX to use all intellectual property rights in and to your User Submissions, and to enable inclusion and use thereof as contemplated by the Site and these Terms. You retain all of your ownership rights in and to your User Submissions.

Product Descriptions

SGDX makes all reasonable efforts to display the products listed for sale on its Site as accurately as possible. However, the colors we use, as well as the display and color capabilities of your computer monitor, will affect the colors that you actually see on your screen. SGDX cannot guarantee that your monitor’s display of any product color, texture or detail will be accurate. In addition, SGDX does not warrant that product descriptions or other content are accurate, complete, reliable current or error free. While SGDX makes every effort to ensure that our products are described and priced accurately, in the event that an item is deemed to be priced incorrectly, SGDX reserves the right to refuse sale that item. If the pricing error is discovered after payment has been finalized, SGDX reserves the right to cancel the sale and refund the transaction in full. If a product offered by SGDX is not as described, your sole remedy is to return it in unused condition. All items are subject to availability. We will inform you as soon as possible if the product(s) you have ordered are not available.

Comments and Suggestions

We appreciate hearing from our customers and welcome your comments and suggestions regarding SGDX’s website(s) and the products offered for sale by SGDX, provided that such comments and suggestions are not illegal, obscene, threatening, defamatory, invasive of privacy, infringements of intellectual property rights or otherwise objectionable or injurious to third parties and do not contain or consist of viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of “spam.” You may not use a false email address, impersonate any person, or otherwise mislead us as to the origin of any comment or suggestion.

Price Changes & Product Availability

At SGDX, we aim to keep our prices as competitive and fair as possible, in order to pass the savings onto our valued customers. However, the prices of our diamonds, gold and other precious stones and metals are aligned very closely with the international market rates and standards. SGDX reserves the right to adjust our prices accordingly as deemed fit. Therefore, the price of an item may be updated without prior notice. At SGDX, we seek to maintain a balance between storing our product stock and reducing our inventory listings. Therefore some of our popular products may be sold out and may take up to 4 weeks to be available, depending on the processing lead time required from our manufacturing department. Should you encounter any product(s) that you are interested in but is deemed as unavailable, you may contact us at support@sgdx.com to check on the soonest available period.

A promotional discount cannot be used:

After an order has been placed; or

In conjunction with any other offer or discount (sales Item) on Loose Diamonds, unless otherwise stated.

Promotional discounts are:

Only available while supplies last; Non-transferable, not for resale, and not redeemable for cash; SGDX reserves the right to withdraw, amend or cancel a discount offer without prior notice.

SGDX reserves the right to amend the Terms and Conditions including price modification of a promotion or offer, terminating the offer before its stated validity date, changing of promotion or offer details, or any other changes in order to protect the interests of the company or under circumstances of abuse.

Occasionally, an error may occur and goods may be either incorrectly priced or described, in which case we will not be obliged to supply the goods at the incorrect price, in accordance with the incorrect description, or at all. We reserve the right to correct any errors from time to time. We will at our own discretion either cancel your order and refund the price you have paid, or use reasonable endeavors to contact you and ask you whether you wish to continue with the order at the correct price or description. If we are unable to contact you or you do not wish to continue with the order at the correct price or description, we will cancel your order and refund the price you have paid.
